Terms and Conditions
Receipt of booking confirmation details, via email, will constitute agreement of the following terms and conditions. Any variation to this agreement must be agreed in advance in writing.
This agreement is between The Photographer: Tudor Hart Photography and The Client.
BOOKING DETAILS
The terms of the session shall be confirmed via email for price, terms, timings and number of edited images delivered. After the session the proofs shall be delivered for selection. Please note that these are preview size low resolution jpgs and will be watermarked, and only the final edited images will be licensed for your personal marketing purposes and use. No unedited images can be used.
There is no deposit charged when booking but The Photographer requests that due and considerate notice is given when the client wishes to postpone a session.
It is your responsibility to ensure you arrive on time for your session. Late arrival may result in a shorter session or if necessary the session will need to be re scheduled.
PAYMENT
Where the Client is an individual, the full balance is to be paid by or on the day of the photoshoot, unless otherwise agreed in writing.
RETOUCHING
The final images will be cropped where necessary and retouched including colour grading, blemish removal and any other subtle amendments The Photographer deems creatively and honestly necessary, whilst maintaining the integrity of the true representation of the client. Clients may not retouch the images themselves or by a third party, nor should any filters be used on social media. Any additional retouching must be completed by The Photographer upon request.
DELIVERY of IMAGES
Unless agreed otherwise in writing, The Photographer shall deliver the proofs with 48 hours and the final edited digital images to the client within 4-7 working days, after client’s selection. The digital images will be delivered in both web and print formats via your private gallery.
COPYRIGHT
As set out by the Copyright, Designs and Patents Act 1988, The Photographer retains the copyright to all the images and has the rights to use and reproduce any of the images within their marketing/press materials including online websites and social media platforms. The Photographer grants the client an unlimited license to utilise the edited images for their own marketing use, such as online and professional profiles, platforms and publications (such as theatre programmes).
- Any ‘release’ of such rights is to be agreed in writing prior to the session.
- If the client wishes to supply the images to a third party for commercial or editorial purposes, the photographer must be notified and written consent given. All images must be credited as Tudor Hart Photography and where, and if, appropriate, a license fee arranged.
The Photographer reserves the right to be identified as the author of their work and for a credit when images are shared publicly in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988.
All images must be credited, wherever possible, to Tudor Hart Photography. On instagram @tudorhartphoto
No proof images may be used for any reason other than review by the client to choose images for editing.

WEBSITE DISPLAY & PROMOTIONAL USAGE
The Client hereby allow(s) the Photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, social media etc.
LIMITATION OF LIABILITY
In the unlikely event of images being lost through equipment malfunction or damaged without fault on the part of the photographer, liability shall be limited to a full refund of payments received from the client. The photographer has full Public Liability Insurance.
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
STORAGE OF FILES
The Photographers selected raw images from your shoot are stored on a hard drive for 2 years to allow The Client to order more edits should they wish. The Photographer is however not liable for any technical malfunction of the hard drive. Final retouched images will be stored online for a longer period as a courtesy for archival purposes. It is your responsibility however to store your edited images safely to your own computer & cloud accounts after delivery.
